377_001Vous trouverez ci-dessous un appel contre l’invocation abusive de la légitime défense ainsi qu’une première liste de signataires.

L’appel a pour objectif de mettre en cause le recours qui a été opéré récemment à cet argument par plusieurs Etats dans le contexte de la lutte contre l’Etat islamique. Il ne s’agit pas de nier la possibilité d’exercer la légitime défense dans le contexte de la lutte contre le terrorisme, mais plutôt de rappeler que la légitime défense ne peut s’exercer que conformément aux conditions établies par la Charte des Nations Unies et par le droit international.

A ce stade, la liste des signataires est composée d’internationalistes contactés directement par les rédacteurs du texte. L’appel est désormais ouvert à la signature de tout internationaliste. Toute personne intéressée peut envoyer un courriel à l’adresse suivante : cdi@ulb.ac.be, avec la mention « Invocation abusive LD ». Mentionnez également votre prénom (en minuscule) et votre nom (en majuscules) ainsi que le titre que vous portez dans votre université. La liste des signataires sera actualisée régulièrement sur le site du Centre de droit international de l’U.L.B. : https://cdi.ulb.ac.be).

Tous les internationalistes peuvent signer le texte. L’objectif est de composer deux listes : l’une composée des professeurs, maîtres de conférences ou disposant d’un statut similaire, l’autre des doctorants, assistants ou chercheurs. Jusqu’ici, nous n’avons pas contacté directement des personnes relevant de cette deuxième catégorie. Cependant, il est crucial que l’appel soit soutenu par celles et ceux qui représentent le futur du droit international : nous invitons donc chaudement tous les internationalistes à le signer !

A plea against the abusive invocation of self-defence as a response to terrorism

377_001You’ll find thereafter a plea against the abusive invocation of self-defence and a first list of signatories.

Its purpose is to challenge the invocation of this argument by several States in the context of the war against ISIL. The plea does not deny as such the possibility of using self-defence in the context of the fight against terrorism; it simply recalls that the use of force in self-defence must be in conformity with the conditions laid down in the UN Charter and international law.

So far, the list of signatories consists of international lawyers who have been contacted directly by the drafters of the text. At this stage and with this post, the call to sign the appeal is extended to all international lawyers. Those interested in signing may send an email to the following address: cdi@ulb.ac.be, with the mention ‘Abusive Invocation of SD.’ Please indicate your first (in lower case) and last (in upper case) name as well as your precise affiliation to a University. The list of signatories will be updated regularly and will be posted on the website of the ULB International Law Centre (https://cdi.ulb.ac.be).

All international lawyers can sign the text. Our objective is to have two lists: one composed of professors and academics and one composed of PhD students, assistants and researchers. For the time being we have not contacted directly anyone from this last category. However, we believe it is crucial that the plea be addressed also to those who represent the future of international law and we warmly invite them to sign it.

377_001Abaixo, poderão encontrar um apelo contra a invocação abusiva da legítima defesa, bem como uma primeira lista de signatários.

O presente apelo visa contestar o recurso que foi operado recentemente a este argumento por vários Estados no contexto da luta contra o Estado Islâmico. Não se trata de negar a possibilidade de exercer a legítima defesa no contexto da luta contra o terrorismo, mas de lembrar que a legítima defesa apenas pode ser exercida em conformidade com as condições estabelecidas pela Carta das Nações Unidas e pelo direito internacional.

Nesta fase, a lista dos signatários é composta por internacionalistas contactados diretamente pelos redatores do texto. O apelo encontra-se agora aberto para assinatura de qualquer internacionalista. Quem estiver interessado pode enviar um e-mail para o seguinte endereço: cdi@ulb.ac.be, com a indicação “Invocação abusiva LD”. Não se esqueça de mencionar o seu nome (em minúsculas) e o seu apelido (em letras maiúsculas), bem como o seu título na sua universidade. Contra una invocación abusiva del derecho de legítima defensa para hacer frente al terrorismo

377_001Más adelante, encontrará un llamado contra la invocación del derecho de legítima defensa y una primera lista de signatarios.

El llamado tiene por objetivo criticar el recurso a dicho argumento, llevado a cabo recientemente por diferentes Estados, en el contexto de la lucha contra el Estado Islámico. No se trata de negar la posibilidad de invocar el derecho de legítima defensa en el contexto de la lucha contra el terrorismo, sino más bien de recordar que la legítima defensa puede únicamente ejercerse de acuerdo con las condiciones establecidas por la Carta de la Organización de las Naciones Unidas y el derecho internacional.

En esta fase, la lista de signatarios está compuesta de internacionalistas contactados directamente por el autor del texto. A partir de este momento, el llamado se encuentra abierto a la firma de todos los internacionalistas. Toda persona interesada en firmar, puede enviar un mensaje al siguiente correo: cdi@ulb.ac.be, con la referencia « Invocación abusiva LD ». Mencione también su nombre de pila (en minúscula) y su apellido (en mayúscula), como así también la posición que actualmente ocupa en su Universidad. Todos los internacionalistas pueden firmar el texto. تجد في اسفل الصفحة بيانا للاعتراض علي التذرع المتعسف بالدفاع الشرعي و قائمة اولية للموقعين علي هذا البيان

و الهدف من هذا البيان هو الوقوف ضد التذرع بالدفاع الشرعي من قبل بعض الدول في خضم الحرب ضد الجماعة الارهابية المعروفة بداعش. و يجدر الاشارة الي أن هذا البيان لا ينكر امكانية التحجج بالدفاع الشرعي اثناء مواجهة الارهاب و لكنه يذّكر بضرورة الالتزام بالشروط الوارد ذكرها في ميثاق الامم المتحدة و القانون الدولي عند استخدام القوة تحت حجة الدفاع الشرعي .

يستطيع كافه فقهاء القانون الدولي التوقيع علي البيان . ان هدفنا هو وجود قائمتين: الاولي تحتوي علي قائمة اساتذة القانون الدولي و الاكادميين ،و الثانية تحتوي علي طلبة الدكتوراة و المدرسين المساعدين و الباحثين. الي الآن لم يتم الاتصال المباشر مع المنتمين الي القائمة الثانية و لكن نحن نؤمن بأهميه توجيه هذا البيان الي من يشكلوا مستقبل القانون الدولي و ندعوهم الي التوقيع عليه .

      Merci pour votre message. Non, il n’est possible de signer l’appel que si vous êtes Professeur ou chercheur en droit international.
